Forsythe Homeowners' Assoc. v Susan Vold

WHEREAS, default has been made in the terms and conditions of the Declaration and Covenants, Conditions, Restrictions and Easements for Sundown Homeowner's Association, dated August 21, 1973 and recorded in the office of the Washington County Recorder as document 314755, the Declaration of Condominium Ownership, Sundown Condominium, The Forsythe Section, dated February 27, 1974 and recorded in the office of the Washington County Recorder as document 320579 and the Forsythe Homeowner's Association By-Laws, Sundown Condominium, the Forsythe Section, dated February 4, 1974 and recorded in the office of the Washington County Recorder as document 321155, (collectively referred to herein as the "Governing Documents") which covers the following described property situated in Washington County, Minnesota, to-wit:
Apartment No. 139G of Building 8, Apartment Ownership No. 5, Sundown Condominium, The Forsythe Section, according to the plat thereof on file or of record in the Office of the County Recorder, in and for Washington County, Minnesota.

WHEREAS, pursuant to said Governing Documents, there is claimed to be due and owing as of the date of this Notice by Forsythe Homeowners' Association to Susan J. Vold the principal amount of Five Thousand Seven Hundred Seventy Five and 45/100 Dollars ($5,775.45) for delinquent association assessments, late charges, acceleration of monthly dues through December 2017, interest, filing fees, postage and reasonable past due attorney's fees and expenses to collect on your delinquencies through August 25, 2017; and no action being now pending at law or otherwise to recover said debt or any part thereof; and;
WHEREAS pursuant to said Governing Documents, and the statutes in such case made and provided, said debt creates a lien upon said premises in favor of Forsythe Homeowners' Association.
NOW, THERFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Washington County, Minnesota at the Washington County Sheriff's main office, Washington County Law Enforcement Center, 15015 62nd Street North, in the City of Stillwater in Washington County on November 9, 2017 at 10:00 am, at public auction to the highest bidder, for cash, to pay the amount then due for said condominium assessments, together with the costs of foreclosure, including attorney's fees as allowed by law. The time allowed by law for redemption by the unit owner, her personal representatives, or assigns is six (6) months from the date of said sale.
