NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that Black Diamond Granules, Inc. has submitted an application for an Amended Interim Conditional Use Permit to extend the termination dates for importing of material and site operations by three months. The property is located at 499 Settlers Ridge Parkway. The property is zoned BCD, Business Campus District, and is guided as Places to Work on the Land Use Plan.

The application includes the following described real estate lying and being in the City of Woodbury, County of Washington, State of Minnesota to wit:

The South Two Hundred Forty-Four (244) feet of the Southwest Quarter of the Northwest Quarter (SW ¼ of the NW ¼); the North 1/2 of the Northwest Quarter of the Southwest Quarter (N ½ of NW ¼ of SW ¼); all that part of the Northerly One Hundred sixty-five (165) feet of the Southwest Quarter of the Northwest Quarter of the Southwest Quarter (SW ¼ of NW ¼ of SW 1/4), lying North of the following described line;

(3) A Five (5) acre tract in the Southwest Corner of said North Half of the Southwest Quarter (N ½ of SW ¼) described as the West Six hundred Ninety-three and six-tenths (693.6) feet of the South Three hundred thirty and five-tenths (330.5) feet except the South one (1) Rod. Subject to the rights of County Road No. 72.

(4) The South one (1) rod of the Northwest Quarter of the Southwest Quarter (NW ¼ of SW ¼) and subject to the rights of County Road No. 72 and a One hundred (100) foot pipe line easement through the Northeast Quarter of the Southwest Quarter (NE ¼ of SW ¼).

NOTICE IS FURTHER GIVEN that the Woodbury City Council has scheduled a public hearing to review the request for the application. The public hearing will be held on Wednesday, September 26, 2012 at 7:30 p.m. at Woodbury City Hall, 8301Valley Creek Road.

The purpose of the hearing is to provide citizens the opportunity to comment on the proposed application. Individual citizens or representatives of organizations are encouraged to submit written comments prior to the hearing.

All interested parties will be heard.
