ORDINANCE NO. 1852
AN ORDINANCE OF THE CITY OF WOODBURY, WASHINGTON COUNTY, MINNESOTA PROVIDING THAT THE CITY CODE BE AMENDED BY AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, RELATED TO DEFINITIONS AND ELIGIBILITY FOR GOLF COURSES
THE CITY COUNCIL OF THE CITY OF WOODBURY, WASHINGTON COUNTY, MINNESOTA DOES ORDAIN:
1852.01 That Chapter 4, Alcoholic Beverages, Article I, In General, Section 4-1, Definitions, of the City Code be amended as follows:
Sec. 4-1. Definitions.
Licensed premises is the premises described in the approved license application, and only for a space that is compact and contiguous. In the case of a golf course, "licensed premises" means the entire golf course except for the areas where motor vehicles are regularly parked or operated.
1852.02 That Chapter 4, Alcoholic Beverages, Article II, Intoxicating Liquor, Section
4-25, Eligibility, be amended as follows:
Section 4.25. Eligibility
(a) An off-sale intoxicating liquor license may be issued to an exclusive liquor store.
(b) An on-sale intoxicating liquor license may be issued to the following establishments:
(1) Hotels;
(2) Restaurants;
(3) Bowling centers;
(4) Clubs or congressionally chartered veterans' organizations, provided that the organization has been in existence for at least three years and liquor sales will only be to members and bona fide guests;
(c) An on-sale intoxicating liquor license, an on-sale wine license or an on-sale malt liquor license may be issued to a theatre or golf course within the city, notwithstanding any law. The license issued under this paragraph authorizes sales on all days of the week.
(d) No license shall be granted for any business which principal building is within 500 feet of a principal school building.
1852.03 Severability
In the event that a court of competent jurisdiction adjudges any part of this chapter to be invalid, such judgement shall not effect any other provision of this Chapter not specifically included within the judgement.
1852.04 Effective Date
This ordinance shall become effective upon its passage and publication according to law.
