NOTICE IS HEREBY GIVEN that by virtue of Findings of Fact, Conclusions of Law, Order for Judgment and Judgment, that was entered in the above entitled matter, whereby it is adjudged, among other things, that there is due to the Plaintiff the sum of SEVENTY ONE THOUSAND FIVE HUNDRED SIXTY FIVE AND 89/100 DOLLARS ($71,565.89) with interest from and after September 30, 2011, and that land therein described be sold to partially satisfy the same, with costs and expenses of such sale, a certified transcript of which judgment has been delivered to me by the Court, I, the undersigned Sheriff of Washington County, Minnesota will offer and expose for sale at public auction to the highest bidder on the 8th day of March, 2012 at 10:00 a.m. at the office of Washington County Sheriff, Washington County Law Enforcement Center, 15015 62nd Street North, Stillwater, Minnesota 55082-3801, the land described and directed to be sold in said judgment lying and being in the County of Washington, State of Minnesota, to wit:
1. LEGAL DESCRIPTION OF PROPERTY:
Lot 9, Block 1, Oakdale Meadows, Eleventh Addition, according to the plat thereof on file and on record in the Office of the Registrar of Titles, Washington County, Minnesota.
2. STREET ADDRESS OF PROPERTY:
2279 Hilo Avenue North, Oakdale, MN 55128-5018
or so much thereof as shall be necessary to satisfy said judgment, there interest thereon, and the costs and expenses of such sale; subject to redemption within six (6) months from the date of confirmation of such sale.
Unless said mortgage is reinstated or the property redeemed, or unless the time for redemption is reduced by judicial order, you must vacate the premises by 11:59 p.m. on September 10, 2012.
Notice pursuant to Minn. Stat. Minn. Stat. § 580.04, subd. 7:
"THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED."
Notice of Homestead Designation pursuant to Minn. Stat. § 550.175, subd. 1 and 2:
"PART OF THE PROPERTY TO BE SOLD CONTAINS YOUR HOUSE. YOU MAY DESIGNATE THE AREA OF A HOMESTEAD TO BE SOLD AND REDEEMED SEPARATELY.
YOU MAY DESIGNATE THE HOUSE YOU OCCUPY AND ANY AMOUNT OF THE PROPERTY AS A HOMESTEAD. THE DESIGNATED HOMESTEAD PROPERTY MUST CONFORM TO THE LOCAL ZONING ORDINANCES AND BE COMPACT SO THAT IT DOES NOT UNREASONABLY REDUCE THE VALUE OF THE REMAINING PROPERTY.
YOU MUST PROVIDE THE CREDITOR CAUSING THIS PROPERTY TO BE SOLD, THE SHERIFF, AND THE COUNTY RECORDER WITH A COPY OF THE LEGAL DESCRIPTION OF THE HOMESTEAD YOU HAVE DESIGNATED BY TEN BUSINESS DAYS BEFORE THE DATE THE PROPERTY IS TO BE SOLD."
