NOTICE IS HEREBY GIVEN, that default has occurred in the conditions of that certain Mortgage dated July 26, 2005, and executed by Jesse Thao Real Estate, LLC, a Minnesota limited liability company, as MORTGAGOR(S), to Western Bank, a Minnesota corporation, as MORTGAGEE, filed for record in the office of the County Recorder in and for the County of Washington and the State of Minnesota, on August 4, 2005, and recorded as Document Number 3530381; the original principal amount secured by said Mortgage being Seven Hundred Fifty-five Thousand Dollars ($755,000.00); that no Mortgagors have been released from financial obligation on said Mortgage; that no action or proceeding has been instituted at law to recover the debt secured by said Mortgage, or any part thereof; and that prior to the commencement of this mortgage foreclosure, the holder of said Mortgage has complied with all conditions precedent to foreclosure and/or acceleration of the indebtedness of the Mortgage and all notice requirements of the Statutes and/or the Mortgage, that there is due and claimed due upon said Mortgage, including interest to the date hereof, and taxes, if any, paid by Mortgagee, the sum of Seven Hundred Twenty-five Thousand One Hundred Twenty and 23/100 Dollars ($725,120.23); that all conditions precedent to foreclosure of the Mortgage and acceleration of the debt secured thereby have been fulfilled; and that pursuant to the power of sale therein contained, said Mortgage will be foreclosed and the tract of land lying in and being in the County of Washington, State of Minnesota, legally described as follows, to-wit:

will be sold by the Sheriff of said County at public auction on Monday, the 8th day of June, 2009, at 10:00 o’clock a.m. at Washington County Government Center, 15015 62nd Street North, in the City of Stillwater in said County and State, to pay the debt then secured by said Mortgage and taxes, if any, on said premises, and the costs, attorneys’ fees and disbursements allowed by law. The time allowed by law for redemption by the Mortgagor, his personal representatives or assigns is six (6) months from the date of said sale.
