SENTENCE: The court placed defendant on probation for seven years

under the following conditions: 1) Serve 180 days in Washington County

Jail with credit for 7 days served. Time may be done on work release with

staggered sentencing: 60 days this year, 60 days one year from the date

he starts serving this year, and the next year after that. 30 days before

serving the time each year, he can move to

have that year's sentence suspended. 2) Pay $500 plus surcharges. 3) Under

169A.277, complete 30 days of Electronic Alcohol Monitoring per year of

probation, to be served at the end of the 60 days served each year. 4)

Abstain from the use of all mood altering chemicals, including alcohol and

submit to random testing at his own expense. 5) Complete treatment at

Regions ADAP, live

in sober housing, and follow all continuing care recommendations. 6)

Complete a Driving With Care Program in his county of residence if

available. 7) Attend AA at least once weekly for 12 months and provide

verification to supervising probation officer. 8) Have no same or similar

offenses, be law abiding, and cooperate with all the standard conditions

of probation. 9) Cooperate with the

transfer of his supervision to his county of residence. 10) Provide a

biological specimen for purposes of DNA analysis. 11) Defendant is subject

to 5 year conditional release if he is committed to the custody of the

Commissioner of Corrections.

SENTENCE: Count I: Fleeing a Peace Officer - The defendant was

committed to the Commissioner of Corrections for 1 year and 1 day.

Execution of sentence was stayed and the defendant was placed on probation

for three years with the following conditions: 1) 13 days jail with

credit for 13 days; 2) pay $200 fine plus surcharges; 3) enter and

complete the Washington County Repeat Offender Program and comply with all

program rules; 4) abstain from mood-altering chemicals, including alcohol,

submit to random testing; 5) provide DNA sample per statute; 6) comply

with all chemical dependency programming that defendant is currently

involved in and any recommended aftercare; 7) complete a cognitive skills

evaluation and follow the recommendations; 8) no same or similar offenses,

remain law abiding. Count II: Felony Refusal to Submit to a Chemical

Test - The defendant was committed to the Commissioner of Corrections for

48 months. Execution of sentence was stayed and the defendant was placed

on probation for seven years with five year mandatory conditional release.

The conditions of this probation are the same as Count I with the

additions of: 1) Comply with long term monitoring 30 per year while he is

on probation; 2) serve 22 days in Washington County Jail each year for the

next four years beginning in the fall of 2009.

SENTENCE: The Court committed the defendant to the Commissioner of

Corrections for a period of a year and a day, stay of execution of

sentence, placed the defendant on probation not to exceed three years on

the following conditions: serve 60 days in the county jail, with credit

for one day served; time to be served on in-custody Sentence to Service,

pay $50 fine plus surcharges, complete an evaluation for cognitive skills

programming and follow recommendations, complete chemical dependency

evaluation, follow recommendations, abstain and submit to random testing,

attend AA/NA meetings 2X per week for 12 months and provide

verification, seek and maintain gainful employment, follow standard

conditions of intensive supervision unless supervising probation officer

deems it unnecessary, be law abiding, complete RUDI (Resources for the

Unemployed and Determined Individual) Program. Regarding the misdemeanor

offense, the defendant was given a $1,000 fine, 90 days in the County

Jail, with $730 suspended for 2 years on the following conditions: same

as above, plus attend MADD Impact Panel.

dependency evaluation and follow treatment recommendations; abstain from

use and random testing; obtain prescribed medication through one doctor to
