NOTICE OF PUBLIC HEARING

ON ASSESSMENTS FOR

2013 Roadway Rehabilitation Project - Tahoe Road, Carver Park Drive and Carver Park Circle; Woodlane Hills and Victoria Place; Glen Road (Century Avenue to Radio Drive); Rolling Acres and Century Avenue (Kalen Drive to Military Road)

CITY OF WOODBURY, WASHINGTON COUNTY, MINNESOTA

NOTICE IS HEREBY GIVEN that the City Council of the City of Woodbury, Washington County, Minnesota will meet at the Woodbury City Hall, 8301 Valley Creek Road in said city on Wednesday, May 22nd , 2013 at 7:30 p.m. to hear and pass upon all objections, if any, to the proposed assessments in respect to the 2013 Roadway Rehabilitation Project - Tahoe Road, Carver Park Drive and Carver Park Circle; Woodlane Hills and Victoria Place; Glen Road (Century Avenue to Radio Drive); Rolling Acres and Century Avenue (Kalen Drive to Military Road).

The proposed assessment roll is now on file with the City Clerk and open to public inspection by all interested therein. The general nature of said improvement is for utility and street base improvements and affects the following described property lying and being in the City of Woodbury, Washington County, Minnesota described as follows, to-wit:

Tahoe Road, Carver Park Drive and Carver Park Circle

All parcels within the south half of Section 18, Township 28N, Range 21W, City of Woodbury, County of Washington, State of Minnesota that have direct driveway or private street access to Tahoe Road, Carver Park Drive and Carver Park Circle.

Woodlane Hills and Victoria Place

All parcels within the west half of Section 20, Township 28N, Range 21W, City of Woodbury, County of Washington, State of Minnesota that have direct driveway or private street access to Thames Road, Oxford Drive (from Sherwood Road to Sunbury Drive), Oxford Alcove, Oxford Bay, Oxford Circle, Oxford Court, Tara Lane and Churchill Drive.

Glen Road (Century Avenue to Radio Drive)

All parcels within Section 31 and Section 32, Township 28N, Range 21W, City of Woodbury, County of Washington, State of Minnesota that have direct driveway access to Glen Road or parcel frontage length greater than adjacent roadway frontage.

Rolling Acres and Century Avenue (Kalen Drive to Military Road)

All parcels within the west half of Section 30 and the west half of Section 31, Township 28N, Range 21W, City of Woodbury, County of Washington, State of Minnesota that have direct driveway access to Century Avenue, Kalen Drive, Kalen Circle, Kalen Court and Lynn Way.

The total amount of the assessment proposed is $1,159,575.99. The area proposed to be assessed is every lot, piece, and parcel of land benefited by said improvement, based upon benefits received.

Written or oral objections will be considered. No appeal may be taken unless a written, signed objection is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Appeals to said assessment may be made upon serving of Notice of Appeal upon the Mayor or City Clerk within thirty (30) days after the adoption of the assessment and also filing said Notice with the District Court within ten (10) days after service upon Mayor or the City Clerk.

You are also advised the Minnesota Statutes Section 435.193 - 435.195 provides that any property owner whose property is classed as homestead who is 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments may apply to the City Council for deferment of said assessment. This deferment is discretionary with the Council.
