ORDINANCE NO. 1948
AN ORDINANCE OF THE CITY OF WOODBURY, WASHINGTON COUNTY, MINNESOTA AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, ARTICLE II – INTOXICATING LIQUOR, SECTION 4-25 ELIGIBILITY AND SECTION 4-32 WINE
THE CITY COUNCIL OF THE CITY OF WOODBURY, WASHINGTON COUNTY, MINNESOTA DOES ORDAIN:
SECTION ONE. Amendment:That Chapter 4 – Alcoholic Beverages, Article II – Intoxicating Liquor, Section 4-25 Eligibility be amended as below:
ARTICLE II. - INTOXICATING LIQUOR
Sec. 4-25. - Eligibility.
(a) An off-sale intoxicating liquor license may be issued to an exclusive liquor store.
(b) An on-sale intoxicating liquor license may be issued to the following establishments:
(1)Hotels;
(2)Restaurants;
(3)Bowling centers;
(4)Clubs or congressionally chartered veterans' organizations, provided that
the organization has been in existence for at least three years and
liquor sales will only be to members and bona fide guests;
(c) An on-sale intoxicating liquor license, an on-sale wine license or an on-sale malt liquor license may be issued to a Recreation, Commercial and Public golf course use, as defined by City Code Chapter 24, to an establishment with a maximum food service and bar area of 50 seats, notwithstanding any law. The license issued under this paragraph authorizes sales on all days of the week.
(d) No on-sale intoxicating liquor license, on-sale wine or an on-sale malt liquor license may be issued to a Recreation, Commercial and Public golf course use unless at least 10 percent of the gross food and beverage receipts of the establishment are annually attributable to the sale of food.
1.The Recreation, Commercial and Public golf course use holder of an on-sale intoxicating license exceeding the maximum food service and bar area of 50 seats, shall be required to meet Section 4-28, Food Sales, of this article.
2.The Recreation, Commercial and Public golf course use holder of an on-sale wine license, who is also licensed to sell 3.2 percent malt liquors at on-sale, exceeding the maximum food service and bar area of 50 seats, shall be required to meet the Section 4-12 (d) License Required.
(e) No license shall be granted for any business which principal building is within 500 feet of a principal school building.
SECTION TWO. Amendment:That Chapter 4 – Alcoholic Beverages, Article II – Intoxicating Liquor, Section 4-32 Wine be amended as below:
Sec. 4-32. - Wine.
On-sale retail wine licenses permit the retail sale of wine up to 24 percent alcohol by volume for consumption with food on the licensed premises. On-sale retail wine licenses authorize the sale of wine on all days of the week.
SECTION THREE. Effective date.
This ordinance shall be in full force and effect following its passage and publication according to law.
